An employee who falls from bed to home office for the first time in the morning is protected by statutory accident insurance according to a ruling by the Federal Social Court (BSG). According to the 2nd Senate, walking up the stairs to the home office was only used to take up work for the first time and is therefore insured as a service in the interests of the employer. In the specific case, an area sales manager had sued in the field service who had slipped on a spiral staircase on the way to work from his bedroom to the home office one floor below and had broken a thoracic vertebra in the process.
