Kramer Tunnel: Separation from the construction company – Bavaria

In the dispute over additional costs of almost 50 million euros for the construction of the Kramer tunnel near Garmisch-Partenkirchen, which was last estimated at 365 million euros, the Tyrolean tunnel builder BeMo has now also canceled the contract for the large-scale project with the state building authority in Weilheim. This was announced by the authority on Friday.

The building authority sees the termination of the company on Monday as unlawful. With this, a procedure before the Munich I Regional Court was practically settled, in which the company had to make additional claims for services that were not initially agreed, but from their point of view had become necessary due to corona regulations and loose rock.

The building authority had wanted to have the court determine that these claims are excessive and therefore do not have to be settled with the monthly installments. The court followed suit on Thursday. Due to the lack of further advance payments, this will only have an effect after the termination in a possible legal dispute over the final settlement.

Because the construction company had already withdrawn all workers from the now well-advanced shell construction of the tunnel on August 11th. The building authority wants to ensure that they don’t also withdraw material and machines, but leave them behind for a fee so that another company can continue the work more quickly. A tunnel opening at the end of 2025 has therefore become unlikely.
