Isar: Administrative Court negotiates boating ban – district of Munich

The ordinance on driving bans on the Isar in the district of Bad Tölz-Wolfratshausen during the winter months should probably be permissible. At least there seemed to be more in favor of it than against it in the hearing before the Bavarian Administrative Court on Tuesday. In 2019, the Bavarian Canoe Association and the Individual Paddler Association initiated a norm control procedure, which the 8th Senate is now dealing with. As the presiding judge Judith Müller explained, the encroachment on the fundamental right to be able to move freely there is opposed to the high nature conservation value. The ordinance allows leisure activities to be carried out – just not in certain months. “On the other hand, the encroachment on fundamental rights is perhaps not so difficult if it is a leisure activity that can also be practiced elsewhere,” says Müller.
