Hannover: Frederike case († 17): suspected murderer free again | Regional

Karlsruhe/Hanover – 40 For years, Frederike’s (†17) father, Hans von Möhlmann (†79), fought for justice for his murdered daughter, achieved that the alleged murderer Ismet H. (now 63) can soon be tried a second time. The 79-year-old died just days before the trial. And now? Now the suspected killer is free again for the time being.

In 1981, at the age of 17, Frederike was first raped in the Celle district and then stabbed to death. The suspect Ismet H. was released in 1983 for lack of evidence. Thirty years later, a DNA analysis showed that he could have been the perpetrator. The renewed charge after the acquittal – impossible!

But in February 2022 the handcuffs clicked and Ismet H. was arrested again. The reason for this is a controversial change in the Code of Criminal Procedure, which came into force shortly before the turn of the year.

While critics see the principle violated in the new regulation that no one may be prosecuted twice for the same crime, the survivors are happy.

Unbelievable!

Now Ismet H. had to be released from custody until the trial! The Federal Constitutional Court partially granted the urgent application of the then legally acquitted, as was announced on Saturday in Karlsruhe. It is open whether a new regulation that allows criminal proceedings to be resumed in such cases is constitutional. That can only be clarified in the upcoming main proceedings.
