Fürth: Hitler salute in protest against AfD – fine – Bavaria

The Nuremberg-Fürth district court has sentenced a man to a fine in the second instance for showing the Hitler salute in protest against an AfD stand in the city center. The 47-year-old had stated that he was an opponent of the AfD and that with the gesture he expressed his displeasure with the party’s politics, the Fürth district court announced on Wednesday.

The district court had sentenced the man in the first instance in 2019 to a fine of 2100 euros. The district court has now upheld the judgment against which the defendant had appealed. According to the rulings of the Federal Constitutional Court, the use of Nazi symbols in such cases must be kept within narrow limits.

In the present case, many passers-by – including the police – could have seen the gestures and also heard the man’s Nazi slogans being shouted. Eleven witnesses alone were heard. For them, the slogans were not clearly perceptible as a protest.
