But while he had until October 28 to “Voluntarily enter prison in Spain” in order to serve his six-month sentence, the defender ultimately avoided the worst, as his appeal was accepted by the Spanish courts. “We consider that the appeal must be accepted and that the execution of the sentence of deprivation of liberty imposed on Lucas Hernandez must be suspended”, said the Superior Court of Justice of Madrid in the middle of the week.

A real relief for the Hernandez clan, and in particular for its lawyer, who initially wanted to deny certain information on this case. “It seems surprising to me to read that Lucas avoided jail, when the court clearly overturned an unfair resolution against my client. We have remained silent in the face of all comments, but the true information of the proceedings has not been covered in the press. The first lie is that “Lucas did not serve his sentence”. This is false because his 31-day sentence for the benefit of the community was served by working with an association in 2017. The second lie is that “Lucas Hernandez had two convictions for violence”. But no, that never happened. It was just one incident, when he was 21. Moreover, it is said that the case was resolved urgently because it is about Lucas Hernández, this is not true either. The judge’s order was issued on August 5 and our appeal took place on August 9 and it is now that the Provincial Court has rendered its resolution ”, launched Mauricio Gonzalez in an interview on Marca.

“Avoid unjust incarceration”

Anyway, Lucas’s lawyer has succeeded, and fortunately for the rest of the career of the world champion. “This case had to be done urgently because it would have involved a deprivation of liberty for my client. We had to file complaints with the General Judicial Council and the Provincial Court to avoid unjust imprisonment. Because Lucas could have done prison, before the Court rules against six months later. Except that this passage through prison would have killed Lucas’ professional career, like his personal life. For this reason, the suspension of the sentence was urgently justified by the three magistrates one day before the admission to prison pronounced by the judge ”, said the lawyer of Theo’s brother, who knows that the Bayern player could count on the support of his wife in this difficult test.

“In this case, there is no civil liability, because there is no victim. His wife has been his main support. Amelia never denounced him, she asked for the acquittal of the six-month sentence. We did not understand the decision. Because Lucas is a mature person, he did not have a criminal record. And he has a child with his wife, who is also pregnant with a second baby. The provincial court agreed with us, and we want to close this chapter after having avoided the unjust imprisonment of Lucas ”, concluded Mauricio Gonzalez. Now that this case is more or less behind him, Lucas Hernandez will be able to fully concentrate on his season in Munich, but also in the France team.
