Emmanuel Macron does not want 49.3 on the text and rules out a dissolution of the National Assembly

The President of the Republic, who brought together this Tuesday evening at the Élysée several ministers concerned by the immigration law carried by Gérald Darmanin, indicated that he did not want to use article 49.3 of the Constitution, BFMTV learned. If the Joint Commission does not find an agreement, the text could therefore be abandoned.

Emmanuel Macron announced to several of his ministers this Tuesday, December 12 that there will be no dissolution of the National Assembly or activation of the constitutional weapon of 49.3 to have the immigration bill adopted, despite a significant setback suffered at the Palais-Bourbon, participants at a dinner at the Élysée told BFMTV, confirming information from AFP.

According to our information, the President of the Republic has indicated that he will “not float the subject between Christmas and New Year’s Day”, even if it means abandoning the text in the event of failure of negotiations between 7 senators and 7 deputies in the Joint Joint Commission (CMP).

Because without 49.3, the executive can only rely on this CMP, which will have to decide “as quickly as possible” on the future of the text rejected by a majority of deputies in the National Assembly.

Macron wants to “close the sequence, whether it is positive or not”

If this CMP failed, the text would therefore be abandoned, without a new reading in the Assembly or the Senate, after a year and a half of reversals, negotiations and adventures.

The President of the Republic wants to “close the sequence, whether it is positive or not” and “puts a lot of pressure so that things go quickly”, BFMTV learned.

Positions which leave the door open to three scenarios. The first is the most favorable to the government: an agreement is reached in CMP, the text is put to the vote and adopted, the law is promulgated.

If an agreement is reached in CMP but the National Assembly does not vote on the bill, 49.3 will not be triggered. The text will therefore be rejected. Finally, if no agreement is found between senators and deputies, the CMP will not be conclusive and the text will be withdrawn.

The date of the Joint Commission is not yet known, but senators and deputies should meet in the coming days. Emmanuel Macron wanted this to be done “as quickly as possible”, said a participant at Agence France Presse.

As for the dissolution, the president castigated those “around the table who imagine a dissolution, when there is not even reason to draw a general conclusion from this sequence”, one of the guests told AFP. “If some people consider that it would be a good idea, I tell them that they are wrong and ask them to stop,” Emmanuel Macron is said to have launched, according to our colleagues at RTL.
