With the bill “for the confidence in the judicial institution”, the “reminder to the law” is in the process of being repealed. However, the government intends to replace it with another more restrictive measure for those implicated. Justice Minister Eric Dupond-Moretti announced on Sunday that he wanted to introduce a “probative criminal warning” instead.
This warning, which is also presented as an alternative to legal proceedings, “will be issued by the courts which, for one year, will put the suspects under surveillance. In the event of another offense during this period, they will then be judged for the two offenses, the new and the old ”, explained the Minister of Justice in an interview with Figaro. The new device “will be effective from January 1, 2023,” said the minister.
The call to the law: a “too weak penal response”
The probative penal warning must make it possible to “break with the evanescent character” of the reminder to the law, “penal response too weak to be effective”, underlines the Minister of Justice. Pending the entry into force of the probationary penal warning, reminders of the law will also be gradually abandoned for certain types of offenses.
“From the promulgation of the law, crimes of violence against persons holding public order or holding an elective mandate will be excluded, and on June 1, all crimes of violence”, declared the Minister of Justice.
In 2019, 260,000 reminders of the law had been issued, or 21% of the criminal response. The law “for confidence in the judicial institution” will be examined in the Senate at first reading from Tuesday.
