Dispute in Pullach – Banger look in the mailbox – District of Munich

In the dispute between the municipality of Pullach and the association “Protection of the Isar Valley” over the admissibility of a referendum against the expansion of the United Initiators chemical plant, both parties will soon find a decision by the administrative court in their mail. A court spokeswoman said on Monday when asked that the chamber had already made a decision that had not yet been served on the parties involved, which is why it was unable to provide any information on the judicial decision at the moment. “I expect a positive decision from the court every day,” said the spokesman for the citizens’ initiative Christian Boeck.

The judicial decision may already be available when the Agenda 21 team reports on Thursday, November 11 at its autumn forum in the club room of the Pullach community center on the current status of seven of their projects, all of which contain potential for conflict, such as the one planned Trail guidance of the district office for mountain bikers through the sensitive Isar slope forests or the topic of “mobility concept and traffic calming”. Right at the start of the event, which starts at 7.30 p.m., Peter Kloeber, spokesman for the Agenda Working Group on Energy and Climate Protection, will give a lecture on what is currently the biggest excitement in the area and present the changes to the agenda that have been submitted to the community in detail. Agenda 21 has always benevolently accompanied the community in its projects with advice and action, but recently, especially in connection with the expansion plans of United Initiators, more often with criticism. Their fear that the expansion of the zoning plan and the expansion of the development plan would create the basis for a massive increase in production in the future, largely coincides with the arguments of the “Protection of the Isar Valley” association, which therefore received 775 signatures in July of this year for the initiation of a referendum against the project at Mayor Susanna Tausendfreund (Greens).

The necessary quorum was thus achieved, but three weeks later, the majority of the municipal council rejected the admissibility of the referendum. The reason given was that, according to the expert opinion of a law firm commissioned by the municipality, there were, among other things, considerable doubts about the adequacy of the question and thus about the material legal admissibility.

The question raised is: “Are you in favor of the Pullach community taking all legally available, building and planning-related measures to prevent (further) expansion of the chemical company (peroxide) United Initiators in Pullach?” Some of the citizens were not even clear about what they had signed, “said Andreas Most (Pullach plus).

Christian Boeck is convinced that in this case the municipality will get a “resounding slap” from the administrative court as it did in 2018, when the court, against the will of the municipality, declared a petition against a housing project admissible, which ultimately failed. The petition will go through, also thinks Peter Kloeber, who will presumably be elected as the new agenda speaker for the tired Bert Eisl on Thursday. Proof of 3G is required to attend the meeting.
