Six co-conspirators
The indictment does not identify any of the six alleged co-conspirators who prosecutors say unlawfully agreed to aid Trump’s bid to subvert the election. But five of them were readily identifiable based on the widely known details in the indictment. They are:
- Rudy Giuliani, Trump’s lawyer and the leader of an effort to pressure state legislators to reverse election results.
- John Eastman, a constitutional lawyer who helped develop the strategy to pressure Mike Pence to overturn the election

Pence comes out swinging at Trump following Jan 6 indictment: ‘Should never be president’
Former Vice President Mike Pence didn’t parse words when reacting to former President Donald Trump’s indictment by Special Counsel Jack Smith on Tuesday.
In a statement released following Trump’s indictment on charges related to the Jan. 6, 2021 riot at the U.S. Capitol and efforts to overturn the 2020 presidential election, Pence accused Trump of putting himself over the Constitution, and said a Trump candidacy would serve as a distraction from President Biden’s “disastrous” record.

A Brazen, Dead-Serious Attack on American Democracy
More than two and a half years after Donald Trump attempted to steal the 2020 presidential election, a grand jury in Washington, D.C., has indicted the former president on four felony counts related to the plot.
This is the third time that Trump has been charged with felonies in 2023, but it is also the most significant case against him. Although other charges allege serious misconduct, this cuts to the gravest act he committed: his lengthy, concerted effort to subvert
The First Great Crisis of a Second Trump Term
Both his supporters and and his opponents assume that former President Donald Trump’s legal jeopardy will go away if he can win the 2024 presidential election. That’s a big mistake. A Trump election in 2024 would settle nothing. It would generate a nation-shaking crisis of presidential legitimacy. Trump in 2024 means chaos—and almost certainly another impeachment.
Trump’s proliferating criminal exposures have arisen in two different federal jurisdictions—Florida and the District of Columbia—and in two different state jurisdictions, New York and
