Criminal proceedings – BGH confirms Infinus prison sentences – economy

In one of the largest commercial criminal proceedings in Germany, the Federal Court of Justice (BGH) has largely confirmed the judgments against six defendants. The first instance conviction of the ex-managers of the former Infinus group for gang and commercial fraud and the aid to it were free of legal errors and therefore legally binding, the BGH decided on Friday. The decision of the Dresden Regional Court of July 2018 is not exemplary, but the decisive findings are correct, explained the chairwoman of the 5th Criminal Senate, Gabriele Cirener, the decision. The Dresden Regional Court had imposed prison sentences of between four and a half and eight years in 2018 against the management crew of the Dresden financial services provider. The judges assumed that the injured party invested in bonds and subordinated loans with a total volume of almost 542 million euros and that only a portion had been repaid by the time business was closed. The Dresden Chamber was convinced that the defendants operated a “pyramid scheme” consisting of several companies, advertised investors under the pretense of fake profits and that there was no viable business concept. All of the accused had appealed.
