Confessions or fabrications? Delphine’s husband confronted with his former fellow prisoner

This is key prosecution testimony. Which has led to many twists and turns in recent months in the case of the disappearance of Delphine Jubillar. This Thursday, in the office of the Toulouse investigating judges, her husband, Cédric, will be confronted with Marc-Aurèle, one of his former fellow prisoners. Nicknamed “Marco”, this 37-year-old man from Corsica, claims to have collected last fall the confessions of the Tarn plasterer, then in detention for more than three months for the murder of his wife, who disappeared on the night of 15 to December 16 in Cagnac-les-Mines.

By communicating through the windows of the cells of the Seysses remand center, Cédric Jubillar allegedly explained to him that he had killed the mother of his two children, before going to bury her body in the night near a farm which had recently burned not far from the marital home. But voluble, he would not have limited himself to this simple confession. The main suspect would also have indicated that he used a friend’s “white” car to move the body, facts of which his new companion, Séverine, would be aware.

Confidences that “Marco” did not keep to himself and transmitted to the gendarmes in charge of the investigation a few days before his release from detention. And which have partly guided the investigations since.

Burnt farm, body transport, etc.

Thus, six months after the arrest and indictment of Cédric Jubillar, Séverine was placed in police custody on December 16 for “complicity in concealment of a corpse”. Before being released 36 hours later without prosecution. Still to verify the declarations of “Marco”, in December, the white Peugeot 306 of an acquaintance of the plasterer was seized and multiple samples were taken. A month later, significant resources from the gendarmerie and the army were deployed to survey the land around the place called Drignac, near the burnt farm.

So many elements that will not fail to be discussed this Thursday afternoon in the presence of the two men. During a previous interrogation, Cédric Jubillar had already explained to the two magistrates in charge of the investigation that he had “not said that seriously” to his former fellow prisoner. “This Marco did everything to bond with him. He asked him incessantly what he had done with Delphine. And after having answered him 50 times that he was innocent and had done nothing, he came out with this nonsense, ”explains Emmanuelle Franck, who defends the interests of Delphine’s husband alongside two other lawyers.

The heavy judicial past of the co-detainee

Above all, she says she is “surprised that justice has so much confidence in a man like that” and even wonders if he will appear this Thursday at the Palais de Justice in Toulouse. Because Marc-Aurèle is far from being unknown to the police. He even has a well-stocked criminal record. When he was a minor, he was sentenced to fifteen years’ imprisonment for rape, torture and acts of barbarism. But also twice in prison for tampering with witnesses and false testimony. He was in detention in Seysses after being arrested under an international arrest warrant in Portugal.

She also finds it surprising that he could be released only a few days after his confession to the gendarmes. “It’s a bit curious because a fortnight earlier the criminal court had considered that he should not go out and had refused his request for release”, continues the lawyer who believes that the Corsican “has played his card” in this case.

“This man came to explain that Cédric Jubillar would have confessed everything, he gives the content of the alleged confessions, and this content has come to nothing at all. They searched everywhere, they returned everything near the famous farm and found nothing. Séverine obviously didn’t know anything because they released her and never considered indicting her. And the famous car of the friend who would have been used to transport the body, the Blue Star did not reveal any bloodstains, ”lists Emmanuelle Franck.

A confrontation from which the civil parties do not expect much either. Because for some of them, the trail of confessions is more fiction than reality. “We are on the fake, there is no reason to crack there. From the beginning, I have been convinced that this is manipulation. Since when do you tell your life story to people in prison you’ve never seen? It’s provocation, manipulation, he spends his time doing that. We are obliged to spend time and money to verify all this. He wants to waste the investigators’ time, ”said Maître Philippe Pressecq, who represents the cousin of Delphine Jubillar.

Other expected expert results

Elements which would therefore be deliberately distilled by the main suspect to lose the investigators and launch them on bad tracks at the expense of others. But for the Tarn lawyer, the investigation is still progressing. In particular thanks to the recent expertise added to the file, in particular the pair of broken glasses of the disappeared. “The glasses for me are damning evidence, because when she watches television with her son, the glasses are wearable. When they are found, they are immutable, in the meantime they have suffered a shock”, notes Philippe Pressecq who relies on the conclusions of the General Directorate of Armament which reveals that “the damage observed on the pair of glasses […] are the consequence of dynamic efforts”, as if it had received a blow.

The lawyers keep reminding that Delphine Jubillar’s glasses were broken before the evening of December 15, 2020. “They are split at the level of the frames, even her son explained by a diagram where they were broken before the night of the events , otherwise he could not witness it. There was no blood on them, if they are broken on someone’s nose you can expect there to be. And then Cédric is seen by a medical examiner a few hours later, he has no traces of blows carried or received, ”argues Me Franck.

She is much more attached to the results of the exploitation of data from Delphine’s phone, which shows that it was triggered at 6:52 a.m., while Cédric was with the gendarmes to whom he had reported the disappearance almost three hours earlier. of his wife.

Today, other test results are still awaited. Those of the seven biological traces, sweat, found in the trunk of the famous white car which should have been returned on April 15. But also the analysis, again, of Delphine’s duvet and its cover, on which DNA traces are sought. Just like on the broken glasses. “On the duvet and the glasses, there will obviously be the DNA of Delphine and Cédric, even that of the children. It has no interest, ”concludes Emmanuelle Franck. And she will not hesitate to use it in the weeks to come before the judge of freedoms and detention, when it comes to pleading in favor of the release of her client, on the occasion of the renewal of his warrant of committal, one year after his incarceration.
