City prohibits new building planning at Luitpoldpark – Munich

The plans to create living space on Borschtallee fail due to the objection of the local building commission. Monument conservators are now also checking whether the old building from 1920 needs to be protected.

The residents of two planned single-family houses or optionally an apartment building at Borschtallee 30 in Schwabing would have had a beautiful view of the Luitpoldpark – the houses could be built. But the preliminary building application, which was controversial in the neighborhood, failed. The Local Building Commission (LBK) has rejected the plan to demolish an old villa from 1920 on this exclusive site and instead construct new buildings on a much larger plot. The Schwabing-West district committee had previously rejected the project.

The LBK justifies the negative decision with the situation. The construction project is “not within the districts built in connection with it”, but is a “so-called outdoor area in the inner area”. Which is why Paragraph 35 of the Building Code, which is rarely relevant in inner-city areas, comes into play here.

A construction project like this could be approved if public interests were not impaired and development was secured. In this case, however, there is a lack of connection to the public sewage system. In addition, the land use plan for the property shows a general green area. “In any case, nature conservation in connection with the adjacent Luitpoldpark (biotope) is impaired by the planned resealing and the felling of old trees.” The Luitpoldpark is under monument protection.

Now the Bavarian State Office for the Preservation of Monuments also wants to check whether the old villa also has monument properties.
