After the article was published, Anis Ferchichi, alias Bushido, obtained an injunction from the district court in Hamburg, which allowed the star prohibited from further publishing the article in its original form. That’s why the article was no longer available on stern.de.
Decisive for the decision of the court were mainly formal reasons. The editors gave Ferchichi the opportunity to comment on the allegations before the article was published. However, the court considers that this has not happened to a sufficient extent. Furthermore, the court evaluated some formulations in the article as “prejudgment of the applicant”. However, the Hamburg district court did not contradict the truthfulness of the reported facts because it did not check them at all.
Nevertheless, he determines star-Article and the facts reported therein the progress of the criminal court case against Arafat Abou-Chaker before the Berlin district court. The court will have the recording checked by an independent expert and will listen to the tape in one of the next sessions. Anis Ferchichi, whose testimony had actually already been completed, has to return to the witness stand and be questioned about the tape.
The case against Arafat Abou-Chaker and his brothers is currently the largest criminal case at the largest German criminal court and it is a symbolic case against clan crime. Without the research of star the complex procedures in court are difficult to understand. In addition, the star-Article meanwhile more than pure reporting.
