The withdrawal of party membership for the Brandenburg state parliamentarian Kalbitz remains in place. The Berlin district court dismissed a lawsuit brought by the 49-year-old ex-AfD politician against the federal party.
The Berlin district court has dismissed a lawsuit brought by the Brandenburg state parliament member Andreas Kalbitz against the federal party, which had declared his party membership null and void almost two years ago. The withdrawal of party membership for the 49-year-old remains in place.
In justification, the presiding judge Hans-Joachim Luhm Schier previously explained in a discussion that Kalbitz had concealed his one-year membership in the Republicans in Bavaria in his application for admission to the AfD. Therefore, the declaration of consent to membership is lawfully contestable for fraudulent misrepresentation.
The federal arbitration court of the AfD, like the federal executive board before it, declared Kalbitz’s party membership null and void in the summer of 2020. When he joined the party in 2013, he was accused of failing to declare a previous membership in the now banned right-wing extremist German Youth (HDJ) and in the Republicans between late 1993 and early 1994.
