Berlin district court: AfD does not have to resume Kalbitz

The withdrawal of party membership for the Brandenburg state parliamentarian Kalbitz remains in place. The Berlin district court dismissed a lawsuit brought by the 49-year-old ex-AfD politician against the federal party.

The Berlin district court has dismissed a lawsuit brought by the Brandenburg state parliament member Andreas Kalbitz against the federal party, which had declared his party membership null and void almost two years ago. The withdrawal of party membership for the 49-year-old remains in place.

Republican membership secret

In justification, the presiding judge Hans-Joachim Luhm Schier previously explained in a discussion that Kalbitz had concealed his one-year membership in the Republicans in Bavaria in his application for admission to the AfD. Therefore, the declaration of consent to membership is lawfully contestable for fraudulent misrepresentation.

The federal arbitration court of the AfD, like the federal executive board before it, declared Kalbitz’s party membership null and void in the summer of 2020.

When he joined the party in 2013, he was accused of failing to declare a previous membership in the now banned right-wing extremist German Youth (HDJ) and in the Republicans between late 1993 and early 1994.

AfD boss Tino Chrupalla reacted with the words: “The Berlin district court has decided in the Andreas Kalbitz case. All members must accept this judgment. The task of the federal executive board is now to unite all legitimate currents behind the goals of our party.”

Kalbitz’s lawyer announced during the hearing that he intended to pursue legal action in higher instances.

Kalbitz wants to wait for the “next round”.

Kalbitz did not appear at the hearing himself. In a statement after the verdict, he calmed down the news agency dpa: “Of course I would have preferred a different decision, now the next round remains to be seen.” Kalbitz had always emphasized that he wanted to continue fighting for his party membership in the AfD.
