Bavaria: Acquittal over “Hang the Greens” posters overturned – Bavaria

In connection with posters with the inscription “Hang the Greens”, the Bavarian Supreme Court has acquitted an activist from the right-wing extremist party Der III. removed. Due to a lack of evidence, the Munich I regional court acquitted him of the accusation that he had hung up two such posters as the party’s base leader at the time. The public prosecutor’s office appealed against this acquittal – which has now been upheld. When acquitting the acquittal, the regional court did not adequately address the possibility that the defendant might have committed a criminal offense simply because he was involved in the organization of the poster campaign and was co-responsible for the Der III party. The Bavarian Supreme Court decided that it was gone.

This means that another chamber of the Munich I Regional Court must now decide on the matter again. The verdict against an original co-defendant and former party leader had now become final. He was sentenced to a fine of 140 daily rates of 60 euros each for incitement to hatred and public incitement to criminal offenses. The Bavarian Supreme Court rejected his appeal against the verdict in October as obviously unfounded.
