Bahn fails a second time in court – the strike is allowed to continue
The appeal court in Hesse has also ruled against the railway: the GDL can continue its strike. The strike was “not disproportionate”.

The Hessian state labor court rejected the railway’s appeal in the second instance on Tuesday. The Frankfurt Labor Court had previously rejected the company’s urgent application for an interim injunction against the wave strike by the train drivers’ union GDL on Monday evening.
GDL and Bahn are arguing about a 35-hour week
The union announced the strike on Sunday evening. It began on Monday evening in freight traffic and early Tuesday morning in Deutsche Bahn passenger traffic. In its urgent application, the company argued primarily that the GDL’s strike announcement was made at far too short notice.
The GDL argued that the industrial action was a legitimate means of emphasizing its demands in the collective bargaining round. The crux of the collective bargaining dispute is the GDL’s demand for a 35-hour week for employees in shift work with full wage compensation.
