Allgäu: Judgment after the death of two-year-old in the canal – Bavaria

Because a two-year-old boy drowned in a canal during a daycare excursion, two employees of the facility in the Allgäu were sentenced to fines. The penalty orders of the Memmingen district court for negligent homicide had become final after the objection period had expired on Tuesday, a court spokesman said on Wednesday. He did not provide any information about the amount of the fines.

According to the police, the daycare group visited a playground in Mindelheim (Unterallgäu district) at the end of March when the two-year-old climbed through a barrier on the canal and fell into the water. Police first responders later rescued the child, but attempts at resuscitation failed. The boy later died in a Munich clinic.

In the opinion of the Memmingen public prosecutor’s office, the 26-year-old and the 40-year-old had not adequately fulfilled their duty of supervision. Initially, the authorities said they had also investigated a man who was there on the day-care trip. However, it was an intern at the facility, said a spokesman for the prosecutor. The man had “no criminally relevant duty of supervision” met.
