Acquittal for satirical party in dispute over election poster – Bavaria

In the proceedings regarding election posters by the satirical party “Die Party”, the verdict was made on Tuesday before the Schwandorf District Court: The accused direct candidate, who had hung up election posters with allegedly contemptible and insulting content in August and September 2021, was acquitted, like a court spokeswoman said.

The background to the Schwandorfer case was an election poster that was in use nationwide and that the Regensburg direct candidate of the satirical party had hung up in the Schwandorf district. Among other things, she placed the election posters under the posters of her competitors from the CSU and SPD. The posters showed the words “Feminism, you cunts” and a bloody tampon.

The court justified its judgment with the fact that the expressions on the poster were “not an attack on the plaintiff’s human dignity” because there was insufficient individualization and therefore no insult. Among other things, the accused credibly asserted that she wanted to shake up the population, but not insult anyone in particular or make the woman despicable, explained the court spokeswoman. The accused candidate from the satirical party from Regensburg did not want to accept a penalty order from the public prosecutor’s office in Amberg for a total of 7,200 euros, which is why it came to a hearing. The public prosecutor has announced an appeal against the verdict.
