A young Ivorian expelled by “error”

A young Ivorian, deported to the border despite a suspensive appeal, was expelled by “error”, admitted the Dordogne prefecture on Friday, saying it had offered her a plane ticket to return to France and see her situation re-examined .

This 22-year-old young woman was arrested on January 10 in Périgueux (Dordogne) for acts of reciprocal violence with her spouse, before being subject to an obligation to leave the territory (OQTF) for lack of a residence permit.

But after having seized the administrative justice to challenge this decision, an appeal in principle suspensive, she was nevertheless expelled to Côte d’Ivoire on March 30, even before the administrative court of Toulouse had pronounced.

Respect for fundamental rights

“There was a mistake, acknowledged the prefecture of Périgueux to AFP. The removal should not have taken place before the decision of the administrative court. In the process, the courts canceled the OQTF on March 31, said Cimade, an association that provides legal assistance to asylum seekers and residence permits.

“La Cimade strongly denounces these practices, and calls for respect for the fundamental rights of exiled people,” she wrote in a press release, castigating “an illegal expulsion”. The Dordogne prefecture claims to have contacted the French consulate in Côte d’Ivoire and the young woman to offer her a return plane ticket to France.

“Once in France, she will have to file a file and we will examine her administrative situation,” added the prefecture.
