A septuagenarian embezzles 100,000 euros in allowances intended for his disabled son

He will have to repay or risk going to detention. A 74-year-old man was sentenced Monday in Nice to eighteen months in prison suspended for two years for having embezzled 100,000 euros in allowances and insurance annuities which were intended for his severely handicapped son, and of which he had guardianship, reports Nice morning.

Sentenced for “fraudulent abuse of the ignorance or weakness of a vulnerable person to lead him to a harmful act or abstention”, the septuagenarian was prosecuted for facts which took place between August 2013 and August 2019.

The son could have had “a better life”

According to the regional daily, his son, physically and mentally disabled following a road accident in 1993, is hospitalized 24 hours a day in an institution in Menton (Alpes-Maritimes). “He could have benefited from this money to have a better life,” said the lawyer for the civil party.

The 74-year-old Azurean was also ordered to reimburse the 100,000 euros and to pay 5,000 euros more for non-pecuniary damage. And “if you do not respect the obligation to reimburse, you will go to prison”, concluded the president of the court.
