The Munich Public Prosecutor’s Office has admitted that it made a mistake in confiscating the “Last Generation” domain. The Bavarian State Criminal Police Office had previously confiscated the website of the “Last Generation”, which wants to draw attention to climate change with protest actions, and redirected it to a website of the Bavarian police.

A note was then displayed there that said: “The Last Generation constitutes a criminal organization pursuant to Section 129 of the Criminal Code! (Attention: Donations to the Last Generation therefore constitute criminal support of the criminal organization!)”

The Munich Attorney General cleaned up NDRquestion that this wording is incorrect and that there is currently only an initial suspicion that the “last generation” could be a criminal organization. A spokesman for the Bavarian State Criminal Police Office had previously stated that the Munich Public Prosecutor’s Office had specified the appropriate wording.

Criminal lawyer Mark Zöller from the Ludwig-Maximilians-University in Munich said when asked that he considered the wording “absolutely inadmissible”. Whether the “Last Generation” can be classified as a criminal organization within the meaning of the German Criminal Code is highly controversial and has not been clarified in court to any extent.

“Everything else is pure prejudice and incompatible with the neutrality and objectivity requirement that applies to government agencies,” Zöller continued.

Nationwide raid

Previously, by order of the district court in Munich, 15 properties had been searched nationwide in connection with the allegation that the last generation had formed a criminal organization and investigations had been initiated against seven members.

The “Last Generation” announced that it would take legal action against the actions of the Bavarian authorities.
