Federal Minister of Justice Marco Buschmann has underlined his intention to abolish the currently valid transsexual law. The traffic light parties had agreed in the coalition agreement to replace the law introduced a good forty years ago with a self-determination law. According to the FDP politician, gender identity is protected by personal rights. It belongs to the individual personality.

The queer commissioner of the federal government, Green politician Sven Lehmann, resigned to the ARD Capital Studio announced that the cornerstones of the self-determination law should be in place before the parliamentary summer break. For a long time there had been a struggle for leadership, now the Ministry of Family Affairs and the Ministry of Justice, which are the responsibility of the Greens, are to tackle the law together.

“So far, the applicable statutory law has not sufficiently taken this right of self-determination into account,” said Buschmann in one interview with the editorial network Germany. So far, those affected have had to go through a court procedure in order to have their gender entry changed. Two reports with the most intimate questions would be obtained, Buschmann criticized. “We have to have respect for these people and spare them this sometimes degrading treatment. That’s our goal,” said Buschmann.

Lehmann agrees that no one can provide better information about their own gender identity than each individual. The psychiatric reports should therefore no longer be necessary in the future. Instead, everyone should be able to answer the question of civil status in ID documents in a self-determined manner.

Stressful phases of finding one’s identity

Buschmann said he asked anyone who didn’t take the matter seriously to talk to people who didn’t feel they belonged to their gender in the birth register. They went through difficult and stressful phases of finding their own identity and encountered “a staggering level of prejudice”. At the same time, the state treats them “as if something is wrong with them”.

Both the FDP and the Greens had already submitted drafts for a self-determination law in the previous legislative period. Because they were in the opposition at the time, the drafts had little chance of success.
