The measure repealed by justice in five shopping centers

The court decisions are linked and are not alike. At the very beginning of the week, the Council of State, seized by individuals, validated the health pass in the large shopping centers of the Alpes-Maritimes. But the measure was finally suspended, also Monday, by another judgment of the Administrative Court of Nice and in four establishments which had requested it, we learned this Wednesday from the court, confirming information from
Nice morning.

According to these decisions, the presentation of the QR code is no longer necessary in the three Carrefour centers in Nice and Antibes as well as at Cap3000. Galerie Géant Mandelieu had already obtained the lifting of this obligation on September 8. The sixth establishment concerned, Auchan La Trinité, has not sought justice while the prefectural decree instituting this measure must be extinguished this Wednesday evening. Unless the state services were to extend it. Which seems very unlikely.

Incidence rate below government limit

In its new decision, the administrative court argued that “the government has decided to lift, as of September 8, the obligation to apply the health pass in shopping centers located in departments with a lower incidence rate. to 200 cases per 100,000 inhabitants and in continuous decline for at least seven days ”. This is the case in the Alpes-Maritimes where it stands at 162.

From Tuesday evening, Cap3000 and Carrefour TNL warned their customers that the health pass was no longer required for access to their shopping malls.
