The summary judge decided to partially suspend the prefectural decree establishing this measure.

The magistrate considered “that the condition of urgency”, sine qua non condition of the referral to the judge, “was fulfilled, having regard to the financial, commercial and contractual damages of the applicant company, which justifies the major additional costs to which it is going. to face, and the impact of the measures enacted on the shopkeepers of the center ”.

A few days ago, the same court had rejected the appeal of 34 individuals against the decree establishing the presentation of the “health pass” in the six shopping centers. Decision then taken for “lack of urgency, the applicants not having established that they were unable to access basic necessities within a reasonable geographical area”, the court had specified.
