Soon a national file to list bad-paying tenants?

The FNAIM (national federation of real estate agents) returns to the charge. Last June, after the publication of the Nogal report which aimed to appease relations between landlords and tenants, the federation had already proposed the creation of a national database listing bad-paying tenants. She again brought out this idea this Wednesday, during a press conference.

“The FNAIM pleads for the creation of a file of tenant payment accidents. We have already obtained the agreement of the Cnil on the project “says the federation, which wants to set up its project in 2021. Concretely, the file, drawn up by the company Arthel, would contain the names of tenants who owe more than three months of rent. It would be consultable only by professionals (landlords would not have access to it). “If this project was actually planned, it should be framed by very strong guarantees” explains the Cnil, contacted by Capital.

A file for unscrupulous owners?

On the side of consumer associations, the project had already been strongly criticized last year. “And as a tenant, how do I know if the landlord is serious, if he has already been sentenced, or if he is a sleeper? “declared to 20 Minutes David Rodrigues, lawyer at the CLCV, a consumer association. “This file would only go one way,” he continued. In response, the FNAIM did not show itself closed to the creation of a file which would list the unscrupulous owners who do not return the guarantees. “This solution does not bother me” explained to Figaro Jean-Marc Torrollion, president of the Fnaim.
