The Boandlkramerei defends itself against the accusation that it deceived the city council by submitting a draft program with groups that it had not even asked for in its application for the musicians’ tent at the Oidn Wiesn. The operators of the losing Herzkasperl tent had, as reported, sued against their non-approval and recently also argued that the competitor Boandlkramerei had also achieved its approval “by misrepresenting untruthful facts”. The lawyers also submitted a series of affidavits from musicians that were supposed to prove this.

Now the Boandlkramerei is striking back with its lawyers, the law firm Messerschmidt and colleagues. Peter and Petra Schöniger, the festival hosts of the Boandlkramerei, “never deceived the city during the application,” the lawyers’ press release states. “We submitted our application to the best of our knowledge and belief with a draft of the planned program,” Peter Schöniger is quoted as saying, “and the fact that not all of the requested musicians then accept – also in light of the public discussion about the Herzkasperl tent – is not within our control.” The Herzkasperl tent’s lawyers had argued that a number of musicians had either not been asked at all by the end of the application period or had already declined, but were nevertheless included in the draft program.

In return, the Boandlkramerei lawyers are now demanding that the city “exclude the Herzkasperl tent from the application process, insofar as it is actually the case that one can only apply with a fixed program.” This is because the Herzkasperl tent has also only submitted a draft, which “is considerably less sophisticated than the application from the Schöniger family.” The dispute, which has been played out in public, is damaging the folk music scene in particular, it continues.
