Neubiberg plans right of first refusal – district of Munich

The municipality of Neubiberg hardly has any land of its own that it can build on. But she wants to create more affordable housing in the long term. Therefore, she now wants to secure access to properties in the town center with the help of a right of first refusal. The planning committee has now decided as a recommendation to the municipal council.

By-laws are to be enacted for lots at Main Street Nos. 50, 52, 59, and 61. In the committee debate, the inclusion of plot number 72 was also suggested. Whether it is an option is to be examined before the final decision of the municipal council.

If the latter issues the statute, the municipality can exercise a right of first refusal in the event of a sale of private land. As attorney Gerhard Spieß explained at the meeting, there is no automatism, so the community is not forced to purchase the property. In addition, it must specifically state its urban planning goal – in this case the construction of affordable apartments. “It’s about having your foot in the door,” said the attorney. Mayor Thomas Pardeller (CSU) also emphasized that this is a security instrument, but that he always thinks a private sale is good.
