Nazi saying on Corona demo: 54-year-old has to pay 4000 euros – Ebersberg

The man’s voice sounds harassed, anger resonates audibly when the crucial sentence falls: “You feel like you’re a second-degree half-breed in the Third Reich who isn’t a recognized Jew.” A 54-year-old from the northern district of Ebersberg said these words during a demonstration against the Corona measures in Poing. There is a video recording of the event entitled “Truth, Peace, Freedom” that captures the man’s speech. Therefore, the employee of a security company had to answer to the Ebersberg district court on Tuesday afternoon for incitement to hatred.

However, he himself did not come to the hearing, the accused had asked for an apology, as judge Vera Hörauf explained at the beginning of the hearing. The allegations made against him by the public prosecutor’s office are likely to have been known to the man, after all, he had lodged an objection to the penalty order on the matter. This revolved around the sentence that the 54-year-old is said to have said in January last year at a demonstration against the state-imposed corona protection measures.

In his speech, the man raises other questionable allegations

There was little doubt that the words had actually been spoken that way. The speech was eventually videotaped and was now being played as part of the hearing. Even before the sentence that was now the subject of the trial, the man described the President of the Jewish Community in Munich and Upper Bavaria, Charlotte Knobloch, as “leader of the Zionists”. The 54-year-old said about the applicable Corona rules that even the GDR was “really liberal” on the other hand. From a legal point of view, however, only the comparison with the so-called half-breeds of the second degree, i.e. Germans in the Third Reich who descended from Jewish grandparents, was punishable. The public prosecutor was convinced that this downplaying of the Nazi crimes constituted hate speech.

However, the man’s defense attorney saw it differently. Prior to the speech, his client researched on the Internet and he was not aware that second-degree half-breeds were also being persecuted by the Nazis. “It was not clear to him that there was genocide. He assumed that there were only restrictions,” said the lawyer. That’s why his client drew the comparison to the Corona measures, which would also have entailed certain bans. The man is about the vaccination “very critical” and was not vaccinated himself. Nevertheless, his client’s statements were “completely inappropriate” and “beyond any decency,” admitted the defense attorney. However, he only referred to the restrictions and not to the genocide.

The 54-year-old should have known what he was saying

However, the invited expert from the Institute for Contemporary History in Munich expressed his doubts about this. “Second-degree mixed races were a massively persecuted group. I wouldn’t talk about restrictions there,” he said in court. You don’t have to do a lot of research to get this knowledge either, as the information can be found easily on the Internet. The public prosecutor saw it that way: It was completely inappropriate “to compare corona measures designed to protect people’s health with mass destruction,” he said. Judge Vera Hörauf also agreed with this assessment and finally sentenced the man to a fine totaling 4,000 euros.
