The Berlin district court speaks of fraudulent deception. The AfD had accused Kalbitz, among other things, of having concealed his membership in a right-wing extremist youth organization.

The withdrawal of party membership for the Brandenburg state parliament member Andreas Kalbitz remains in place. The Berlin district court dismissed a lawsuit brought by the 49-year-old against the federal party, which had declared his party membership null and void almost two years ago.

In justification, the presiding judge Hans-Joachim Luhm Schier previously explained in a discussion that Kalbitz had concealed his one-year membership in the Republicans in Bavaria in his application for admission to the AfD. Therefore, the declaration of consent to membership is lawfully contestable for fraudulent misrepresentation.

The federal arbitration court of the AfD, like the federal executive board before it, declared Kalbitz’s party membership null and void in the summer of 2020. When he joined the party in 2013, he was accused of failing to state a previous membership in the now banned right-wing extremist “Heimattreue Deutsche Jugend” (HDJ) and in the Republicans between late 1993 and early 1994.

AfD boss Tino Chrupalla responded with the words: “The Berlin district court decided in the Andreas Kalbitz case. All members must accept this judgment. The task of the federal executive board is now to unite all legitimate currents behind the goals of our party. »
