Mask affair: Andrea Tandler remains in custody – Bavaria

After the Munich district court, the Munich I district court has now decided that the mask millionaire Andrea Tandler and her partner Darius N. will remain in prison. The regional court rejected an appeal by the two against the pre-trial detention. According to the Munich Judicial Press Office, the 6th Large Criminal Chamber for Economic Criminal Matters relied in particular on the fact that “both an urgent suspicion regarding the alleged crimes and the reason for the arrest of the risk of absconding for both suspects” existed.

Andrea Tandler, daughter of the former CSU General Secretary and ex-Minister Gerold Tandler, and Darius N. can now call the Munich Higher Regional Court (OLG). The two have been in custody for a good two weeks. They have long been investigated on suspicion of tax evasion; Andrea Tandler is also concerned with the allegation of subsidy fraud. Both suspects repeatedly denied all allegations before their arrest. They are presumed innocent until they are convicted. The pre-trial detention does not change that.

At the beginning of the corona pandemic, the Munich PR entrepreneur Tandler brokered mask deliveries from the Swiss trading company Emix to several health ministries in Germany and, together with her partner Darius N., collected 48 million euros in commission. The two are said to have evaded income, trade and gift tax or provided assistance. The damage to the tax authorities is said to be around 15 million euros.

It can be assumed that the public prosecutor’s office will bring charges within the next few months. It remains to be seen whether a trial will then take place; and if so, how it ended. The 6th Large Criminal Chamber at the Munich I Regional Court, which has now rejected the complaint, would then probably also be responsible for such a procedure. The chamber is headed by judge Andrea Wagner, who sentenced Munich star chef Alfons Schuhbeck to prison for tax evasion last fall. Schuhbeck has lodged an appeal with the Federal Court of Justice.
