Jonathann Daval ordered to pay 165,000 euros in damages

The Haute-Saône Assize Court on Tuesday sentenced Jonathann Daval, who has been serving a 25-year prison sentence since November for the murder of his wife Alexia Daval in 2017, to pay around 165,000 euros in damages to relatives of the victim.

Jean-Pierre and Isabelle Fouillot, Alexia’s parents, will receive nearly 130,000 euros. The victim’s sister, Stéphanie Gay, her husband and their son, will also be compensated, as will Alexia’s godfather. On the other hand, the other relatives of the victim were rejected of their requests. Members of Alexia Daval’s family have decided to appeal the decision of the Haute-Saône Assize Court.

The loss of Alexia “underestimated”

“The loss of Alexia in such abject conditions was obviously underestimated, we are therefore going to appeal this judgment, even if it remains anecdotal insofar as Jonathann Daval is insolvent”, declared Me Jean-Hubert and Gilles-Jean Portejoie.

During the hearing on civil interests, on February 22, the relatives of Alexia Daval had claimed more than 800,000 euros in damages, requests deemed “disproportionate” by Jonathann Daval’s lawyers. Me Jean-Hubert Portejoie, lawyer for the parents, sister and brother-in-law of the victim, had however argued that these requests took into account “the media coverage, the accumulation of dramas experienced by the civil parties and their close ties with Alexia ”.

What amounts paid by the State?

According to Mes Portejoie, who defend Alexia’s parents, her sister and her brother-in-law, as well as several uncles and aunts, “the next and real debate will take place before the Civi (Commission for the compensation of crime victims) which will rule in the coming weeks on the amounts paid by the State ”.

The Civi “can align itself with the decision of the Assize Court or reduce or increase the sums allocated”, specify the lawyers who ask the compensation commission for “the same sums” as before the court.
