Heavier sentences on appeal for the four perpetrators of sexual assault

This is the “first act” of the “Calvary of Shaïna”, judged by the Amiens Court of Appeal, in the words of her family’s lawyer, Me Negar Haeri. The four perpetrators of sexual assaults committed in 2017 in Creil (Oise) against this 13-year-old girl, murdered two years later, received heavier sentences. The Court of Appeal sentenced them to between six months and two years in prison suspended on Thursday.

These convictions come before the opening on Monday of the trial of another young man, accused of having stabbed and burned the teenager alive in 2019. The sentences are all heavier than at first instance in 2022, but less severe than those demanded by the public prosecutor’s office during the hearing in April. The main perpetrator of the sexual assaults, 14 years old in 2017 and then boyfriend of Shaïna, was sentenced to two years in prison, suspended, and will be registered in the file of sex offenders.

“The triumph of Shaïna’s speech”

The Advocate General had requested against him two years in prison, one of which is closed. In the first instance he was sentenced to one year in prison with probationary suspension. His co-authors, aged 16 and 17 at the time of the events, were both given a one-year suspended prison sentence. They had been sentenced at first instance to eight months suspended probation.

The oldest defendant, tried for a previous sexual assault, and acquitted at first instance, was given a six-month suspended prison sentence. “It is the triumph of Shaïna’s word” in the face of aggressors who showed during the hearings, behind closed doors, “a form of arrogance in their contestation and denial of the facts”, greeted Me Haeri.

A “relentlessness” against the girl

Shaïna’s brother, Yasin Hansye, lamented that the qualification of rape was not retained. According to Shaïna’s complaint, her boyfriend had blackmailed her by using a naked photo to drag her to a disused clinic, where the trio had assaulted her. A video showing her then partially naked, trying to hide her sex under the insults, was shown at the hearing.

The dissemination of these images on Snapchat had exposed her, according to her brother, to “relentlessness” in her city. In May 2019, she again filed a complaint for a beating by the same ex-boyfriend, who for these facts was recently referred to the juvenile court for aggravated violence and death threats. On October 25, 2019, Shaïna was stabbed and burned alive, pregnant, in a shed in her city. His alleged killer, 17 years old at the time of the events, will be tried from June 5 before the assize court for minors in Oise.
