Federal Social Court:Entitlement to a discount-free pension
The Federal Social Court (BSG) has strengthened the right to a deduction-free pension for those who have been insured for many years. According to this, insured persons can also receive the pension if they initially find temporary accommodation in a so-called transfer company due to the bankruptcy of their employer and then become unemployed shortly before the start of retirement, the judges in Kassel ruled on Thursday. (AZ: B 5 R 11/20 R) According to the legal provisions, insured persons can retire early after 45 years in the statutory pension insurance without any deductions. As a rule, periods of unemployment in the last two years before the start of retirement are not counted towards the 45 years. Exception: the insured have lost their job due to the insolvency of their employer. In this case, subsequent periods of unemployment count towards the waiting period for the deduction-free pension.
