Disputed commission payment: Public prosecutor files charges after mask deal – Bavaria

Charges have been brought against the former managing director of a company in Upper Palatinate because of an allegedly unnecessary commission payment for a mask deal, from which his partner is said to have benefited in particular. Investigators from the Regensburg public prosecutor’s office assume that the 54-year-old subsequently fabricated an agreement for a commission of almost 230,000 euros – for a delivery of ten million surgical masks to the State Office for Health and Food Safety. According to the public prosecutor’s office, however, the order would have been concluded even without special mediation due to a previous mask contract.

The recipient of the payment is said to have forwarded a large part of the money to the ex-managing director’s partner. The ex-managing director is therefore accused of breach of trust, and the husband and his partner are each accused of aiding and abetting it. Because the ex-managing director and the other defendant are said to have not told the truth about the business deals as witnesses before the Bavarian State Parliament’s mask investigation committee in autumn 2022, both are also accused of giving false unsworn testimony. Based on the committee’s work, the criminal investigation department and public prosecutor’s office began investigating the trio in December 2022.

According to the public prosecutor, the three suspects have denied the charges and are presumed innocent until a final conviction is made. If a conviction is made, the money from the commission payment could be reclaimed. To make this possible, the investigators say they have secured the relevant assets. The Regensburg Regional Court will now decide whether the case will go to trial.
