Compensation to compensate for refused leave in public hospitals

The staff of public hospitals who will be refused leave due to the health crisis will be able to benefit from an allowance of 110 to 200 euros gross per day not taken, as last year, according to two texts published on Sunday in the Official Journal. This device, which comes into force as the 3rd wave of the Covid-19 epidemic overwhelms hospitals, concerns officials or contractors “who have a balance of annual leave” or RTT not taken because refused for reasons of service “between February 1 and the end of the state of health emergency”, indicates a decree.

The measure applies to health establishments, as well as to those accommodating the elderly or taking care of disabled people, coming under the public hospital service. The personnel concerned will have until December 31 to choose either to benefit from this compensatory allowance, or to postpone the days at their disposal or to enter them in their time savings account (CET).

A limit of 10 days compensated

For three to five days of refused leave whereas they had to be taken between February 1 and April 30, the agent can benefit from “an additional day for the calculation of his balance of leave”. From six days refused, his balance is credited with two additional days.

If he chooses to receive the allowance, the agent will be entitled to 110 euros per day not taken if he is in category C, 130 euros in category B and 200 euros in category A, within the limit of 10 days compensated, according to a decree published in addition to the decree. The texts repeat the measures taken at the end of 2020 for hospital workers who had not been able to take certain leaves or RTT between October 1 and December 31, at the time of the second wave of the epidemic.
