Cancer patient sues social security to have her costly treatment covered

Should the Social Security cover the difference in cost between a generic drug and a branded one, when a patient has no other solution than the most expensive one? This is a question that could be decided soon by the courts following the complaint filed by a woman suffering from breast cancer in Allier, reports The Parisian.

It must be said that, for the very procedural administration, the situation is a special case: the patient, who has been monitored and treated for almost ten years for her cancer, began a new protocol in March 2023, with a generic drug that her body does not tolerate, unlike that of the private laboratory Vidal.

Exceptional aid for two months, then nothing

And the remaining cost for the family between the two treatments is high: 2,200 euros per year, with Social Security only reimbursing up to the price of the generic. After exceptional financial assistance for two months, Health Insurance (CPAM) cut off all support.

A situation that the patient and her husband do not understand and who have hired a lawyer to file a complaint against the CPAM.
