Appeal accepted, no prison for Lucas Hernandez, sentenced to six months in prison

The French international from Bayern Munich, Lucas hernandez, sentenced in Spain to six months in prison for non-compliance with a removal measure after domestic violence, will not go to prison, the Spanish justice having accepted his appeal on Wednesday. “We consider that the appeal must be accepted and that the execution of the sentence of deprivation of liberty imposed on Lucas François Bernard Hernandez must be suspended”, indicated in its decision the higher court of justice of Madrid.

Before his appeal was accepted, the former Atlético de Madrid player had until 11:59 p.m. Thursday to report to the Spanish prison of his choice to serve his six-month prison sentence. This suspension of sentence remains, however, conditional on the fact that the player, who will have to pay a fine of € 96,000, “does not commit a new offense” for a period of four years, the court said.

Suspension of sentence, but not exonerated

This last accepted appeal follows others rejected by the Spanish courts, underlined that the footballer was a “repeat offender” because of his conviction of 2017 for “injuries in the context of domestic violence”, of that of 2019 for non- respect for the expulsion measure, but also for an “other conviction” for “domestic violence”, the details and date of which have not been communicated.

Contacted by 20 minutes a few days ago, the Spanish criminal lawyer and criminologist Marta Pellón Pérez told us that, “in any case, if the appeal is accepted, it does not mean that Mr. Hernandez is cleared, because the two judgments for violence and for violation of the penalty are final ”.
