A court of appeal fixes for the first time the compensation of the plaintiffs

In the legal battle against TUV, the German certifier of defective PIP breast prostheses, the Aix-en-Provence Court of Appeal set the amount of compensation to be paid to 13 complainants on Thursday, a first which should serve as a reference. , announced the association of victims Pipa.

The Court of Appeal sentenced TUV Rheinland to compensate these women (one Colombian, two Spaniards, two Britons and eight Venezuelans) in amounts ranging from 7,000 to 37,135 euros, with an average of 16,555 euros, details in a Pipa press release, which identified in this case some 35,000 complainants around the world.

Up to 6,000 euros per woman

Since the start of the case thirteen years ago, the courts, in particular commercial courts, had awarded the plaintiffs provisions ranging from 3,000 to 6,000 euros per woman, but this is “the first time that a court has made a decision on the final compensation”, according to the association.

TUV Rheinland, which employs 20,000 people worldwide for a turnover of around 2 billion euros, disputes this point: “The decision is not final because everything depends on the judgments expected from the Court of Cassation on contradictory decisions of different courts of appeal, ”reacted Me Christelle Coslin, the group’s lawyer. For the German certifier, the bill could ultimately exceed 500 million euros, estimates Pipa.
